Tractor trolleys cannot ply on highways under provisions of Motor Vehicles Act

New Delhi/Chandigarh.

Punjab and Haryana High Court has censured the protesting farmers who are camping at the Shambhu border with hundreds of tractors. A two-judge bench comprising acting chief justice GS Sandhawalia and Justice Lapita Banerji said that protestors cannot disrupt public life.

The court said, tractor trolleys cannot be used on highways as per the Motor Vehicle Act. The bench also questioned the Punjab government for permitting such a large assembly of farmers. The high court was hearing a PIL filed by advocate Uday Pratap Singh, a resident of Panchkula. The petitioner pointed out that the road blockade has been causing inconvenience to residents and has also been a hindrance to the movement of ambulances, school buses, and pedestrians since February 13.

“How can you go in a tractor-trolley? According to the Motor Vehicles Act, you cannot use tractors and trolleys on the highway…. You are travelling on your tractors and trolleys from Amritsar to Delhi… Everyone knows about their rights, but there are also constitutional duties,” the Bench observed.

As per TheTribune’s report, the Punjab Government, in its affidavit, submitted that the Haryana Police had intimated that the protesting farmers were mobilising heavy earth moving equipment, JCB etc., following which the office of Special DGP, Law and Order, Punjab, directed all the Commissioners of Police and SSPs in Punjab that “no JCB machines or any other heavy machine is allowed to move towards Patiala and Sangrur districts”.
