Chennai. A petition has been moved before the Madras High Court challenging the Tamil Nadu Hindu Religious and Charitable Endowments Act, 1959.
The plea came up for admission before a Bench of Chief Justice Sanjib Banerjee and Justice PD Audikesavalu last Tuesday, when the Court directed the State to file its counter affidavit within four weeks after receiving the case papers.
The petitioners have challenged the validity of the Tamil Nadu Hindu Religious and Charitable Endowments Act,1959 as a whole on the ground that the State cannot monitor or maintain places of worship pertaining to any religion whatsoever.
The Court recorded the same in its interim order as well –
“The petitioners have challenged the vires of the Tamil Nadu Hindu Religious and Charitable Endowments Act, 1959. The challenge here is not to any particular provision but to the entirety of the Act on the ground that the State cannot monitor or maintain places of worship pertaining to any religion whatsoever.”
The matter has been listed for further hearing on October 5, 2021.
