Delhi – NIA Special Court Sentences one ISIS Terrorist to 7 years Rigorous Imprisonment

New Delhi. NIA Special Court, New Delhi sentenced accused namely Shajahan VK S/o Ahammed Haji Kattintivda R/o Darul Sharaf, P.O. Koodali, Kannur, Kerala to 07 year’s rigorous imprisonment (RI) and fine of Rs. 73,000/ for the offences punishable under section 120B read with 125, 419, 420, 467, 468, 471 of IPC, sections 18, 38 & 39 UA (P) Act, 1967.

The case was initially registered at PS Special Cell, New Delhi under Sections 420, 467, 468, 471, 120-B of the Indian Penal Code, Sections 18, 20, 38 of the Unlawful Activities (Prevention) Act, 1967 and Section 12 of the Passport Act, 1967. Accused Shajahan was arrested on 01.07.2017 at IGI Airport, New Delhi on deportation by the Turkish authorities. Another accused Mohd. Mustafa was arrested from Chennai, on 12.07.2017. Subsequently, the NIA took over investigation of the case on 05.09.2017.

Shajahan Velluva Kandy is a member of proscribed international terrorist organisation ISIS. He had associated himself with ISIS with the intention to further its activities. In Oct. 2016, he along with his family had gone to Turkey via Malaysia with an intention to go to Syria to fight on behalf of ISIS. However, while crossing Turkey-Syria border, he along with his family were apprehended by the Turkish authorities and deported back to India on 01.02.2017. In his desperation to serve the cause of ISIS, he procured an Indian passport again on the basis of forged documents and in April 2017, he travelled to Turkey via Thailand and was apprehended again while attempting to cross to Syria. Thereafter, he was again deported to India on 01.07.2017 and was arrested. After investigation, NIA had filed charge Sheet on 23.12.2017 against two accused persons namely Shajahan Velluva Kandy and Mohd. Mustafa.

Trial against other accused person is continued.
